BPAY SCHOOLS PROMOTION ("PROMOTION")
TERMS AND CONDITIONS


1. Information on how to enter this Promotion and Prize details form part of these Terms and Conditions of entry (Terms). These Terms apply to the Promotion and entry into the Promotion is deemed acceptance of these Terms.

2. The promoter is BPAY Pty Liited (ABN 69 079 137 518) of Level 1, 255 George Street, Sydney NSW 2000, Australia (Tel: 02 9646 9222) (Promoter).

3. Entry into the Promotion will be open from 00:00am (AEST) on 25 September 2017 and will close on 12:59pm (AEDST) on 30 March 2018 (Promotion Period).

4. Entry is open to all schools in Australia which have a minimum of 500 students enrolled at the school at any one time, and excludes:

(a) management, employees, directors and contractors of the Promoter, its related entities, and other agencies, firms or companies associated with the Promotion (including suppliers of Prizes);

(b) a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 4(a) of these Terms;

(c) schools which are registered as BPAY Billers prior to the Promotion Period;

(d) persons who have won a prize or prizes valued either individually or collectively at more than $5,000 (including GST) in any Promotion run by or on behalf of the Promoter, within the 12 months prior to the commencement of the Promotion Period;

(e) persons who have used or attempted to use any more than one name in order to qualify to win a promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and

(f) persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter,

(Eligible Entrants)

The persons referred to in paragraph 4(b) of these Terms includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion. By entering this Promotion you represent that you are eligible to enter.

5. To enter the Promotion, Eligible Entrants must, during the Promotion Period:

(a) Contact their financial institution and follow the steps to register as a BPAY Biller;

(b) Email the Promoter at sales@bpay.com.au and provide the Eligible Entrant's school name, address, contact telephone number and BPAY Biller code;

(c) Implement BPAY as a payment method for debtors to provide payment to the Eligible Entrant; and

(d) Receive a BPAY payment from a debtor;

 

(Eligible Entry)

6. The Promotion consists of two stages:

(a) The first fifty (50) Eligible Entrants to submit an Eligible Entry within the Promotion Period (Stage 1) will win a Stage 1 Prize (Stage 1 Prize Winners).

(b) The Stage 1 Prize Winners will then go into a final draw (Stage 2), with the first Stage 1 Prize Winner to be drawn electronically to win the Stage 2 Prize.

7. There is a limit of one entry per Eligible Entrant school during the Promotion Period. The use of any automated entry software of any other mechanical or electronic means that allows an entrant to automatically enter the Promotion repeatedly is prohibited and will render entries submitted using such means invalid.

8. Eligible Entrants can only enter the Promotion in their school's own name.

9. The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. Entries will be deemed to be accepted at the time of receipt by the Promoter. No responsibility will be taken for lost, late or misdirected entries or entries not received for any reason. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.

10. Incomplete, illegible, indecipherable or incorrect entries, or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights (including intellectual property rights) are invalid.

11. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win. The Promoter reserves the right to disqualify entries in the event of noncompliance with these Terms.

Stage 1 Prize

12. The first fifty (50) Eligible Entrants to submit an Eligible Entry within the Promotion Period will win a Stage 1 Prize (Stage 1 Prize Winners).

13. The Stage 1 Prize is a rebate of $1,000 (inclusive of GST), to be paid directly to each Stage 1 Prize Winner via an electronic funds transfer (Stage 1 Prize).

14. The total prize pool for Stage 1 consists of fifty (50) rebates, with a total value of $50,000 (including GST).

15. The Promoter accepts no responsibility for any variation in the value of the Stage 1 Prize, or for any tax liabilities that may arise from winning the Stage 1 Prize.

16. The Stage 1 Prize is not transferable and cannot be exchanged as cash. All other costs associated with the Stage 1 Prize are the responsibility of the Stage 1 Prize Winner.

17. The Stage 1 Prize Winners will be notified by phone and in writing by email within 2 days of  the date of their Eligible Entry.

18. The Stage 1 Prize Winners' details will be published in The Australian newspaper within 30 days of the closing of the Promotion Period.

19. If the Promoter is unable to contact a Stage 1 Prize Winner to claim fulfilment of a Stage 1 Prize within 3 months of the date that the Stage 1 Prize Winner was notified, or the Stage 1 Prize Winner cannot provide suitable proof as required by clause 29, the Promoter will award the Stage 1 Prize to the next Eligible Entrant who submitted an Eligible Entry within the Promotion Period who was not within the first fifty (50) Eligible Entries. For the avoidance of doubt, the fifty-first (51st) Eligible Entry will then be deemed a Stage 1 Prize Winner, and so on, until fifty (50) Stage 1 Prizes are awarded to Eligible Entrants who claim the Stage 1 Prize.

Stage 2 Prize

20. Only Stage 1 Prize Winners will be eligible to win the Stage 2 Prize.

21. A computerised draw (Draw) for the Stage 2 Prize will take place at 12.00pm (AEST) on 30 April 2018 (Draw Date) at MDSA Promotion Marketing, 15 Grosvenor Street, Neutral Bay NSW 2089 (02 9953 9633) (Draw Location).

22. The first Stage 1 Prize Winner with the first valid Eligible Entry drawn electronically will win the Stage 2 Prize (Stage 2 Prize Winner).

23. The Stage 2 Prize is a payment of $10,000 (including GST) to be paid to the Stage 2 Prize Winner via electronic funds transfer (Stage 2 Prize).

24. The total prize pool for the Promotion is $60,000 (including GST), consisting of fifty (50) Stage 1 Prizes and one (1) Stage 2 Prize.

25. The Promoter accepts no responsibility for any variation in the value of the Stage 2 Prize, or for any tax liabilities that may arise from winning the Stage 2 Prize.

26. The Stage 2 Prize is not transferable and cannot be exchanged as cash. All other costs associated with the Stage 2 Prize are the responsibility of the Stage 2 Prize Winner.

27. The Stage 2 Prize Winner will be notified by phone and in writing by email no later than 2 May 2018.

28. The Stage 2 Prize Winner's details will be published in The Australian newspaper on 9 May 2018.

29. The Promoter reserves the right to request that the Stage 1 Prize Winners and Stage 2 Prize Winner (together, the Winners, or individually a Winner) provide proof of his / her registration as a BPAY Biller prior to awarding a Prize. Proof of registration as a BPAY Biller is at the discretion of the Promoter. In the event that a Winner cannot provide suitable proof, in the timeframe required by the Promoter, the Winner will forfeit the Prize and no substitute will be offered.

30. If the Promoter is unable to contact the Stage 2 Prize Winner to claim fulfilment of the Stage 2 Prize by 30 July 2018 or the Stage 2 Prize Winner cannot provide suitable proof as required by clause 29, a computerised re-draw for the Stage 2 Prize will take place at 12:00pm (AEST) on 30 July 2018 (Re-draw Date) at the Draw Location, subject to any written directions given by State and Territory gaming departments. The re-draw Stage 2 Prize Winner will be notified by phone and in writing by email no later than 1 August 2018. The re-draw Stage 2 Prize Winner's details will be published in The Australian newspaper on 8 August 2018.

31. The Stage 1 Prize and Stage 2 Prize (together, the Prizes) will be delivered to the Winners via electronic transfer to the Winner's Business Account (which must be in the name of the entrant school, and not an individual) within 28 days of, in the case of Stage 1 Prize Winners, the date of the Eligible Entry, and in the case of the Stage 2 Prize Winner, the Draw Date or Re-draw Date, as applicable.

32. In the event that the Promoter is unable to supply the Prizes, the Promoter reserves the right to supply an alternative prize of the same or greater value, subject to any written directions given by State or Territory gaming departments.

33. The Promoter’s decision is final on all matters and no correspondence will be entered into.

34. Winners must, at the Promoter's request, participate in all promotional activity (such as publicity and photography) surrounding the winning of the Prizes, free of charge, and they consent to the Promoter using the schools' name and images in promotional material for an unlimited time and without remuneration.

35. Eligible Entrants agree and acknowledge that all entries and any intellectual property rights subsisting in their entries become and remain the property of the Promoter.

36. The Promoter collects personal information about entrants to include entrants in the Promotion and where appropriate award the Prizes. If the personal information requested is not provided, the entrant cannot participate in the Promotion. By participating in the Promotion, each Eligible Entrant consents to disclosing their personal information to the Promoter and the Promoter using and disclosing their personal information to the relevant authorities in the relevant States, the Promoter's related entities, the Promoter's agencies and other third parties engaged to provide services in connection with the Promotion (including suppliers of Prizes) for the following purposes:

(a) conducting the Promotion;

(b) contacting the entrant in relation to the Promotion;

(c) publishing the Winners' names and State / Territory of residence in accordance with
these Terms and as required under relevant legislation;

(d) improving the Promoter's or the Promoter's related entities' goods and services;
and

(e) in the Promoter's and its agencies case, the purposes set out in the Promoter's privacy policy (available at http://www.bpay.com.au/Privacy.aspx or by writing to the Promoter at the address set out in paragraph 2 of these Terms).

The Eligible Entrant provides this consent until such a time as they withdraw their consent by giving notice to the Promoter. Eligible Entrants can also gain access to, update or correct any personal information held by contacting the Promoter at the details listed in paragraph 2 of these Terms. The Promoter's privacy policy also contains information about how Eligible Entrants can make a complaint. All personal information will be stored at the office of the Promoter.

37. The Promoter is not responsible for any technical malfunctions or problems with internet or network congestion, including injury or damage to a participant’s or any other person’s computer related to participation in this Promotion and problems with transmission of entries and / or emails over the internet, acts in violation of these terms and conditions, acts in a disruptive manner, or acts with the intent to annoy, abuse, threaten or harass any other person.

38. Acceptance and use of the Prize is subject to any terms and conditions imposed by those involved in providing goods and/or services as part of or in connection with the Prize (Third Party Terms). The Winners are responsible for complying with all applicable Third Party Terms, and bear all risk associated with failure to comply with any of them. The Promoter assumes no liability (and will provide no compensation) as a result of any failure to comply with any Third Party Terms.

39. All costs associated or arising in connection with participating in the Promotion and the Prize are the responsibility of the Eligible Entrants. Any costs associated with accessing the internet are the Eligible Entrant's responsibility, and depend on the internet service provider used.

40. The Promoter will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, in connection with this Promotion or as a result of accepting or using the Prizes, except for any liability which cannot be excluded by law.

41. If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law

(a) to disqualify any entrant; or

(b) subject to any written directions from any applicable regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
